Highside Real Estate, LLC ("Company," "we," "us," or "our"), operating as Cooper and Highside AI Concierge, is committed to protecting the privacy and security of your personal information. This Privacy Policy describes how we collect, use, disclose, and safeguard information when you use the Cooper AI concierge platform and related services ("Service").

By using the Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with the practices described in this Policy, please do not use the Service.

This Policy applies to all users of the Service, including applicants, trial users, and paying subscribers. It supplements but does not replace our Terms of Service.

2. Information We Collect

We collect information you provide directly to us, information generated through your use of the Service, and limited technical information necessary to operate and improve the Service.

2.1 Information You Provide

• Account Information: When you apply for or create an account, we collect your name, email address, company name, and role.
• Application Details: When you apply for access, we collect information about your professional background, business needs, and how you heard about the Service.
• Payment Information: Billing information (credit card number, billing address) is collected and processed directly by our payment processor, Stripe. We do not store full credit card numbers on our systems.
• Communications: We collect the content of communications you send to your Cooper agent via email, Telegram, or web chat, including all requests, responses, attachments, and conversation history.
• Correspondence: If you contact us directly (e.g., for support or inquiries), we retain records of that correspondence.

2.2 Information Generated Through Your Use

• Conversation History: All interactions with your Cooper agent, including your messages and the agent's responses, are stored to enable the agent to learn your preferences and maintain context across sessions.
• Task and Deliverable Records: Records of tasks completed, documents produced, and actions taken on your behalf.
• Usage Data: Information about how you use the Service, including features accessed, frequency of use, and interaction patterns.
• Agent Memory: Structured information that your agent retains about your preferences, priorities, projects, contacts, and working style over time.

2.3 Technical Information

• Log Data: IP address, browser type, operating system, pages visited, and timestamps of access when you use our web interfaces.
• Device Information: Basic information about the device used to access the Service.
• Cookies: We use a minimal number of essential cookies to maintain your session and authenticate your account. See Section 8 for details.

3. How We Use Your Information

We use the information we collect for the following purposes:

• Service Delivery: To operate, maintain, and improve your Cooper agent; to process and fulfill your requests; and to generate responses, deliverables, and briefings on your behalf.
• Personalization: To enable your agent to learn your preferences, working style, and context over time so it can provide increasingly tailored assistance.
• Account Management: To create and manage your account, process payments, and communicate with you about your subscription.
• Communication: To send you service-related communications, including your daily briefings, task notifications, and account updates. We may also send you information about new features or relevant service improvements.
• Security and Fraud Prevention: To protect the integrity of the Service and prevent unauthorized access, abuse, or fraudulent activity.
• Legal Compliance: To comply with applicable laws, regulations, and legal processes, and to enforce our Terms of Service.
• Service Improvement: To analyze aggregate usage patterns and improve the overall quality of the Service. This analysis uses aggregated and de-identified data where possible.

We do not use your personal information for targeted advertising, and we do not sell your data to third parties. We do not build advertising profiles from your usage of the Service.

4. AI Processing Disclosure

Specifically:

• Anthropic Claude: Your conversation inputs and relevant memory context are processed by Anthropic's Claude language models to generate your agent's responses. Anthropic processes this data under a data processing agreement that prohibits use of your data to train models for other customers.
• Processing Scope: Only the information necessary to generate a response to your specific request — including relevant prior context from your agent's memory — is transmitted to the AI model for processing.
• No Cross-User Training: Your conversations are not used to train AI models that serve other users or customers.
• Model Outputs: Responses generated by AI models are not reviewed by human employees at Highside Real Estate, LLC in the ordinary course of business, unless you specifically request review or support.

By using the Service, you consent to this AI processing as necessary to deliver the functionality of the Service.

5. Data Retention

We retain your information for as long as necessary to provide the Service and fulfill the purposes described in this Policy.

5.1 Active Accounts

For active subscribers, we retain your conversation history, agent memory, and account information throughout the duration of your subscription. This retention is essential to the core value of the Service — Cooper's ability to remember you, learn from your history, and provide increasingly personalized assistance depends on maintaining this data.

5.2 After Account Termination

Following termination or cancellation of your account, we will retain your data for a period of up to ninety (90) days to allow for account reactivation and to fulfill any outstanding legal or contractual obligations. After this period, your personal data will be deleted or anonymized, except as required by law or as necessary to resolve disputes, enforce our agreements, or comply with legal obligations.

5.3 Deletion Requests

You may request deletion of your conversation history or other personal data at any time by contacting us at [email protected]. We will process deletion requests within thirty (30) days, subject to legal requirements and technical feasibility. Note that deleting conversation history will affect your agent's ability to maintain context and personalization.

6. Third-Party Services

We work with a limited number of trusted third-party service providers to operate the Service. These providers process your data only as necessary to provide their services to us and are bound by appropriate data processing agreements.

We will respond to all rights requests within thirty (30) days of receipt. We may ask you to verify your identity before processing a request. We reserve the right to deny requests that are manifestly unfounded, excessive, or technically infeasible, and will provide reasons for any denial.

8. Cookies and Analytics

8.1 Cookies We Use

We use a minimal set of cookies to operate the Service:

• Session Cookies: Essential cookies that maintain your authenticated session while you use the web interface. These are deleted when you close your browser.
• Authentication Cookies: Persistent cookies that remember your login state so you do not need to re-authenticate on every visit. These expire after a defined period.

We do not use third-party advertising cookies, cross-site tracking cookies, or social media tracking pixels.

8.2 Analytics

We collect basic usage data to understand how the Service is being used and to identify opportunities for improvement. This is limited to server-side log analysis of aggregate usage patterns. We do not use Google Analytics, Meta Pixel, or similar third-party analytics services on our primary service interfaces.

8.3 Cookie Controls

You may configure your browser to refuse or delete cookies. Note that disabling essential session cookies will prevent you from using the authenticated portions of the Service.

9. Data Security

We implement reasonable and appropriate technical and organizational measures to protect your personal information against unauthorized access, disclosure, alteration, or destruction. These measures include:

• Encryption of data in transit using TLS/HTTPS
• Encryption of sensitive data at rest
• Access controls limiting employee access to user data on a need-to-know basis
• Isolated, per-client environments for agent data and conversation history
• Regular security reviews and monitoring

No method of transmission over the Internet or method of electronic storage is completely secure. While we strive to use commercially reasonable means to protect your personal information, we cannot guarantee absolute security. In the event of a data breach that is required to be reported under applicable law, we will notify affected users in accordance with legal requirements.

10. No Sale of Personal Data

We do not sell, rent, trade, or otherwise transfer your personal information to third parties for their own marketing, advertising, or commercial purposes. Your data is not an asset for sale. We will not sell your personal data now or in the future without your explicit prior consent.

If our business is acquired or merged with another entity, your personal data may be transferred as part of that transaction. We will provide notice of any such transfer and the acquiring entity will be required to honor this Privacy Policy.

11. Children's Privacy

The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that we have collected personal information from someone under 18, we will take steps to delete that information promptly. 12. Governing Law

This Privacy Policy and any disputes arising under it shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action arising under this Privacy Policy shall be brought exclusively in the state or federal courts located in Travis County, Texas.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. We will post the updated Policy on our website and update the "Effective Date" at the top of this page. For material changes, we will provide additional notice via email or a prominent notice in the Service.

Your continued use of the Service after the effective date of any updated Privacy Policy constitutes acceptance of the updated terms.
